3.

Brief facts of the case are that the assessee trust filed an application for registratio n u/s 12A(1)(ac)(ii) on 20.08.2025. Ld. CIT(E) issued a notice seeking documents to establish the nature and genuineness of charitable activities. On perusal of reply filed by the assessee, ld. CIT(E) sought further information regarding multiple cash transactions from assessee's bank a/c and asked it to furnish documentary evidences to substantiate that the expenses w ere made for char itable activities. Since the documentary evidences and explanation file d by the asse ssee were not found to be satisfactory, ld. C IT(E) rejected the assessee's application vide order dated 09.12.2025. Aggrieved, the assessee is in appeal before the Tribunal.

4.

At the outset, ld. AR submitted that the assessee is carrying out g enuine char itable activities and, therefore, another opportunity be allowed to furnish further evidences in this regard buy remanding the matter to ld. CIT(E). Ld . DR has not objected to the said proposition.

5.

After hearing the rival submissions and perused the material on record, we deem it appropriate to restore the matter to ld. CIT(E) for fresh consideration of the application after giv ing due opportunity to the assessee.

6.

In the result, appeal of the asse ssee is allo wed for statistical purposes.
