Judgment
G. K. Mathur, J.—This revision is directed against the order dated 13th September, 1985 passed by Sri S. B. Verma, IInd Additional Sessions Judge, Jaunpur in Criminal Appeal No. 193 of 1984. The revision has been admitted on the question of amount of compensation only.
Heard learned Counsel for the applicants.
The revisionists had been convicted for the offence punishable under Section 480, I. P. C. and they have been given benefit of Section 4 of the U. P. First Offenders'' Probation Act and each of them had been required to pay Rs. 100/ by way of compensation to the complainant.
Learned Counsel for the applicants argued that according to the case of the prosecution the damage caused to the complaint was to the extent of Rs. 300/ only and the amount of compensation awarded by the Courts below would come to Rs. 600/. He submitted that in this view of the matter the amount of compensation be reduced to Rs. 300.
The amount of compensation awarded by the Courts below is not to be judged by the amount of actual damage only. Moreover, the compensation had been awarded in 1984 and as such I see no reason to reduce the amount of compensation. The revision has no force.
The revision is dismissed. The revisionists are given two months'' time to deposit the amount of compensation outstanding against them.
Let a copy of this judgment be given to learned Counsel for the revisionists within a week on payment of usual charges. Revision dismissed.
