Heard learned counsel for the petitioner as well as learned Standing Counsel.

Vide order dated 21.1.2015, learned Standing Counsel was granted four weeks time to seek instructions. Till date, he has not received any instructions.

Submission of learned counsel for the petitioner is that annexure-3 to the petition, which is a seniority list of daily wage employees clearly indicates that the petitioner was appointed in June, 1985. The same fact is reflected from document dated 29.8.2013 at page 24. It was next submitted that date of appointment of the petitioner has deliberately been lowered as November, 1988 so as to give benefit of regularization to other persons. Insofar as the regularization of the petitioner from the date when his juniors were regularized is concerned, learned counsel for the petitioner states that admittedly petitioner has now been regularized in the year 2016.

In view of the fact that the matter is pending for more than three years and learned Standing Counsel has not received instructions, no fruitful purpose would be served by keeping this petition pending, as both parties agree that the matter can suitably be looked into by respondent no.2-Deputy Director (Horticulture), Allahabad Region, Allahabad by going through the original records.

Accordingly, the present petition stands disposed of with a direction to respondent no.2 to consider the grievance of the petitioner and decide the same preferably within a period four months from the date of production of certified copy of this order on its own merits without being influenced by any of the observation made by this Court.
