The petitioner has filed this writ petition seeking the following reliefs:
To issue a writ of mandamus or any other writ, order or direction directing the first respondent to admit the petitioner to the college she opted for under Kudumby Category Reservation considering her qualification, eligibility and her rank.
According to the petitioner, she belongs to the Kudumbi Community, which comes under Socially and Educationally Backward Classes (SEBC). She applied for admission to the LLM course, 2022-2023 and secured 46th rank in the LLM Entrance Examination conducted by the Commissioner for Entrance Examinations, respondent No.1.
It is submitted that in the category-wise list, the petitioner secured first rank in the Kudumbi reservation category, and as per the mandatory reservation provision mentioned in the prospectus issued by the first respondent, the Kudumbi community has 1% reservation in the centralised allotment process. According to the petitioner, in spite of the same, she did not get admission in any Government Colleges; instead, the 423rd rank holder, who is the second rank holder in the category-wise list, which is far below the rank of the petitioner, was admitted to a self-financing college under the Kudumbi reservation.
The learned Government Pleader Sri. P.G. Pramod, on instructions, submitted that this year, Kudumbi reservation is provided in the self Financing Colleges. However, the petitioner has sought admission under the reserved category in the Government Law College, Thiruvananthapuram. Therefore, it can be seen that the admission sought for by the petitioner in Thiruvananthapuram Law College on the basis that she belongs to SEBC community cannot be granted, since no reservation in that category is provided this year in the Government Law College, Thiruvananthapuram.
The learned Government Pleader further submitted that the petitioner can participate in the mop-up counselling, which would be considered taking into account the reservation sought for by the petitioner.
Therefore, after having heard the learned counsel for the petitioner, learned Government Pleader Sri. P.G. Pramod for the first respondent, and perusing the pleadings and materials on record, this writ petition is disposed of recording the above aspects and leaving open the liberty of the petitioner to participate in the mop-up counselling.
