Judgment
By way of this petition, the petitioner has prayed for grant of anticipatory bail in connection with FIR No. 124 of 2017, dated 10.05.2017, registered against him at Police Station Indora, District Kangra, under Sections 15 of the ND & PS Act and Section 39 of HP Excise Act.
On 26.05.2017, this Court had granted anticipatory bail in favour of the petitioner and also directed the State to file status report. Status report stands filed by the State today in the Court and the same is ordered to be taken on record. A perusal of the status report demonstrates that the allegations against the present petitioner are that he was carrying out the business of illicit liquor as well as drugs in his residential premises at village Surajpur, Tehsil Indora, District Kangra, and the said products were concealed by him in a tank constructed below a bathroom in a room. It is further mentioned in the report that since illicit liquor and drugs were recovered from the premises of the petitioner, he was absconding till he appeared for the purpose of investigation pursuant to directions passed by this Court while granting him anticipatory bail.
Learned Deputy Advocate General has submitted that taking into consideration the amount of illicit liquor which has been recovered from the residential premises of the petitioner as well as the drugs which stand recovered from his premises, custodial interrogation of the petitioner is must as he is involved in manufacturing and trafficking of illicit liquor and drugs and he is not revealing the correct facts during the course of investigation.
Accordingly, in this background, this Court is not inclined to interfere in the matter and this petition is accordingly dismissed. Protection granted to the petitioner, vide order dated 26.05.2017, stands revoked. Petition stands disposed of.
