Inherent powers of this Court under Section 528 of the Bharatiya Nagarik Suraksha Sanhita, 2023 (BNSS) have been invoked seeking correction of certain typographical errors that have crept into the order dated 08.12.2025 passed in M.Cr.C. No.56445/2025, whereby the benefit of bail was extended to the petitioner.
Learned counsel for the petitioner submits that in the said order, the crime number has been incorrectly mentioned as Crime No.260/2025 instead of Crime No.212/2025; the Police Station has been wrongly mentioned as Police Station Kotwali, District Ashoknagar instead of Police Station Sirol, District Gwalior; the date of arrest has been erroneously mentioned as 28.06.2025 instead of 30.09.2025; and the offence has been wrongly described as punishable under Sections 108, 3(5) of BNS instead of punishable under Section 34(2) of the Excise Act.
Upon perusal of the record, the submissions made by learned counsel for the petitioner appear to be correct and are duly supported by the material available on record.
Consequently, the present petition is allowed. The typographical errors that have crept into the order dated 08.12.2025 passed in M.Cr.C. No.56445/2025 are hereby corrected. Wherever the expressions “Crime No.260/2025” “Police Station Kotwali, District Ashoknagar” “The applicant has been arrested on 28.06.2025” “offence punishable under Sections 108, 3(5) of BNS” occur in the said order, they shall be read and substituted as “Crime No.212/2025” “Police Station Sirol, District Gwalior” “The applicant has been arrested on 30.09.2025” “offence punishable under Section 34(2) of the Excise Act”
The remaining contents of the order dated 08.12.2025 shall remain unchanged and intact. This order shall be read as part and parcel of the order dated 08.12.2025 passed in M.Cr.C. No.56445/2025.
A copy of this order be preserved in the record/docket of M.Cr.C. No.56445/2025.
Accordingly, the present M.Cr.C. stands disposed of in the aforesaid terms.
