Judgment
The petitioner undertakes to affirm and stamp the petition as per the Rules within 48 hours of resumption of normal functioning of the court. The
petition is taken up through video conference on the basis of such undertaking.
The petitioner claims that merely because of certain objectionable posts by the petitioner on social media, the case has been started against him.
The State says that irresponsible and unsubstantiated statements have been made pertaining to the functioning of hospitals, particularly in the present
time of crisis.
Considering the nature of the charge, the petitioner’s custodial detention may not be necessary as long as he reports to the investigating officer as
and when called. The petitioner is also requested to exercise extreme care and caution before spreading any form of misinformation in the social
media.
Subject to above, in the event of arrest, the petitioner will be granted bail on furnishing security of Rs.10,000/- (Rupees Ten Thousand) together with
personal release bond of equivalent value to the satisfaction of the arresting officer.
The petitioner will also comply with the conditions laid down in Section 438(2) of the Code.
