Judgment
Heard Learned Counsel for the Petitioner, Mr. S.P. Dhal, Learned Counsel for the Forest Department, Mr. C.A. Rao & Learned Counsel for the Transport Department Mr. P.K. Panda,
By means of this Writ Petition, the Petitioner has prayed for issuance of a direction to the Opp. Parties to release the vehicle bearing registration No.QR-09E-7946 which had been seized by the forest officer from the Joda Bumebaro road side when the said vehicle was on parking & for disposal of Confiscation Proceeding (U.D. Case No. ICH of 2008-2009).
In this connection, the R.T.O. Keonjhar may assess the present value of the vehicle in question & on the Petitioner depositing the same, the vehicle in question shall be released in his favour. Let copies of the Writ Petition be served on Mr. C.A. Rao, Learned Counsel for the Forest Department & Mr. P.K. Panda, Learned Counsel for the Transport Department.
In view of the above, we dispose of this Writ Petition with a direction that the R.T.O, Keonjhar shall assess the value of the vehicle bearing registration No. OR-09E-7946 & on deposit of the amount assessed towards the value of the vehicle the forest authorities shall release the same in favour of the Petitioner, which shall be subject to the order passed in the confiscation proceeding. For the purpose of confiscation proceeding, the Petitioner shall appear before the Authorized Officer-cum-D.F.O. Keonjhar on 22.12.2009.
