The present appeal pertains to the year 2016 and at that point of time certain defects including non-filing of the Court fee were pointed out by the office.
Despite time been granted by the Registrar (Administration) on 08.12.2016 and further by the Court on 23.03.2017 and 23.11.2023, the defects have not been removed till date.
None had appeared for the appellant on 23.11.2023 when the matter was listed. However, this Court granted last opportunity of two weeks to remove the defects as pointed out by the office and it was observed that if the defects are not removed within the stipulated period, the appeal shall be listed before the Court for dismissal.
As per the office report, the defect No.4 has not been removed till date.
In view of the same, the present appeal is dismissed in non-prosecution as well as non-compliance.
Stay petition, application under Section 5 of the Limitation Act and all pending applications, if any, stand disposed of.
