Rakesh Chandra Gupta and Others vs State of U.P. and Others

Hon''ble Rajesh Dayal Khare, J.—Pursuant to the earlier order of this Court dated 10.05.2012, notices were issued to the applicants for engaging another counsel as Sri O.N. Tripathi, learned counsel for the applicants had expired. Office report dated 10.07.2012, shows that notices have been served personally upon the applicants but no any counsel has put in appearance on behalf of the applicants.

Sri P.S. Mehra, learned counsel for the private opposite party is present.

The present 482 Cr.P.C. petition has been filed for quashing the order dated 30.09.2003 passed by learned Special Judge (E.C.) Act in Criminal Revision No. 308 of 2002 whereby the criminal revision filed by the opposite party no. 3 has been allowed and direction has been issued for registration of the case on an application u/s 156(3) Cr.P.C. against the applicants.

Since none has appeared on behalf of the applicants in spite of service of notice as per office report dated 10.07.2012.

Accordingly, the present application is dismissed for want of prosecution. Interim order, if any, granted earlier stands vacated.
