S.N. Aggarwal, J.—Counsel for both the parties jointly submit that this matter has been compromised between the parties and in terms of

their compromise, they have agreed that whatever amount was deposited by the petitioner with the Registrar General pursuant to the Court order

dated 28.08.2006 be released in favour of the workman (respondent No. 1 herein) in full and final settlement of all his claims arising out of the

impugned award.

It is submitted that the petitioner had deposited an amount of Rs. 95,908/- including litigation expenses of Rs. 7,500/- with the Court pursuant to

the Court order dated 28.08.2006. Respondent No. 1 is stated to have already withdrawn an amount of Rs. 7,500/- allowed as litigation expenses

and the only deposit that is lying with the Registry is stated to be Rs. 88,408/-.

Ms. Rashmi B. Singh, learned Counsel appearing on behalf of the petitioner, on instructions from her client, says that this amount of Rs.

88,408/- deposited by the petitioner pursuant to the Court order dated 28.08.2006 may be released in favour of respondent No. 1 towards final

settlement of all his claims arising out of the impugned award.

Ms. Rama Shankar, learned Counsel appearing on behalf of respondent No. 1, on instructions from his client present in the Court, accepts the

offer given to him by the counsel appearing on behalf of the petitioner.

In view of the above and having regard to the submissions made by the counsel for the parties, this writ petition is disposed of as compromised

between the parties.

The Registry is directed to release the amount of Rs. 88,408/- along with interest accrued thereon in favour of respondent No. 1 forthwith.

All pending miscellaneous applications also stand disposed of.
