Judgment
Accused in Crime No.142/2026 registered by Chamarajanagar Rural Police Station, Chamarajanagar District for the offences punishable under Sections 329(4), 352, 115(2), 74, 119(1), 118(1), 126(2), 76 and 190 of the Bharatiya Nyaya Sanhita (BNS), 2023, is before this Court in this petition filed under Section 482 of BNSS, 2023 seeking anticipatory bail.
Heard the arguments of the learned counsel for the parties.
FIR in Crime No.142/2026 was registered by Chamarajanagar Rural Police Station for the aforesaid offences against the petitioner and others based on the first information dated 11.07.2026 received from Smt. Nandini. Apprehending arrest in the case, the petitioner had filed Crl. Misc. No. 296/2025 before the jurisdictional Sessions Court which was rejected against him on 28.07.2026. Therefore, he is before this Court.
First informant is the alleged victim in the present case. A perusal of the material on record would indicate that, the injured victim Nandini is the friend of Sowbhagya. Petitioner had earlier allegedly quarrelled with Sowbhagya. On 10.07.2026, the petitioner allegedly came to the shop of the first informant and inquired as to why she was supporting her friend Sowbhagya. He thereafter, allegedly, forcibly entered the shop of the first informant and tried to outrage her modesty. He also allegedly snatched the gold chain which she was wearing in her neck. When her son came to stop him, the petitioner allegedly snatched the mobile phones of the first informant and her son. Thereafter, the other accused persons came near the shop of the first informant and assaulted them.
Learned HCGP has produced the wound certificate of the injured victim Nandini, which would indicate that, she had sustained only scratch injuries on her head, neck and back, and the said injuries are certified as simple injuries by the Medical Officer, who had given the first-aid treatment to the victim lady.
It is brought to the notice of this Court that, the petitioner is a person with criminal antecedents. Considering the aforesaid aspects of the matter, I am of the opinion that the prayer made by the petitioner for grant of anticipatory bail needs to be allowed, subject to appropriate conditions. Accordingly, the following:
ORDER
The petition is allowed. The respondent - Police or any other Police in the State of Karnataka are directed to release the petitioner in the event of his arrest in Crime No.142/2026 registered by Chamarajanagar Rural Police Station for the offences punishable under Sections 329(4), 352, 115(2), 74, 119(1), 118(1), 126(2), 76 and 190 of BNS, 2023, subject to the following conditions:
The Petitioner shall appear before the Investigating Officer within 15 days from the date of receipt of the copy of this order and shall execute a personal bond for a sum of Rs.1,00,000/- with two sureties for the likesum to the satisfaction of the investigating officer.
Petitioner shall regularly appear before the Trial Court without fail unless exempted by the Trial Court for valid reasons.
Petitioner shall not tamper with the prosecution witnesses and he shall co-operate with the police for investigation and appear before them whenever called upon.
The petitioner shall not involve in similar offences in future.
The petitioner is directed to appear before the Station House Officer, Chamarajanagar Rural Police Station, Chamarajanagar on second Sunday of every month between 10.00 a.m., and 01.00 p.m., and mark his attendance, till the investigation is complete and the charge sheet is filed.
