Judgment
V. Narasingh, J
Heard learned counsel for the petitioner and learned counsel for the State.
The petitioner is an accused in connection with Special G.R. Case No.92 of 2021, pending before the Court of the learned Sessions Judge-cum-Special Judge, Malkangiri, arising out of Orkel P.S. Case No.173 of 2021 for alleged commission of offences under Sections 20(b)(ii)(C)/27-A of the NDPS Act.
Being aggrieved by the rejection of his application for bail U/s.439 Cr.P.C. by the learned Special Judge, Malkangiri by order dated 15.03.2023 in the aforementioned case, the present BLAPL has been filed.
Perused the order rejecting the bail application of the present petitioner.
It is revealed that out of eleven charge sheeted witnesses seven have already been examined by 15.03.2023.
Considering the same and taking into account that the contraband (ganja) involved is to the tune of 217 kg 800 grams, this Court is not inclined to entertain this bail application during the currency of trial.
Accordingly, the BLAPL stands disposed of.
Learned Court in seisin is called upon to expedite trial.
It is incumbent upon the petitioner to produce the order before the learned Court in seisin.
