Allowed. The application stands disposed of.
CWP No. 7997 of 2011.
The writ petition is filed with the following prayer:
That the respondent authorities may be directed to transfer the petitioner from Govt. Middle School Bhujund under complex Govt. Sr. Sec. School Tindi, Lahaul & Spiti, H.P. to the stations of choice of the petitioner by issuance of writ of mandamus.
It was for the petitioner to make an appropriate representation before the second respondent. Without making such representation, the petitioner should not have filed the present writ petition seeking writ of mandamus. However, in view of the apology tendered by the learned counsel, we reluctantly refrain from dismissing the writ petition on that ground.
The writ petition is disposed of as follows.
In the event of the petitioner filing an appropriate representation before the second respondent, the same shall be considered adverting also to the vacancy position as pointed out by the petitioner in the representation and appropriate action in the matter shall be taken within another two months. The pending application(s), if any, also stands disposed of.
