Judgment

The petitioner, who was arrested and remanded to judicial custody on 14.12.2023 by the respondent Police for the alleged offence under Sections 120(b), 420, 465, 467, 468, 471, 109, 170 of IPC r/w. 12(1A)(a), 12(1)(b) altered into 12(2) of Passport Act, 1967, r/w. Section 14C Foreigners Act, 1946 and Sections 66C, 66D of Information Technology Act, in Crime No.1 of 2024, seeks bail.
The allegation made against the petitioner is that he is the owner of a browsing centre and on his browsing centre, several passports were applied for several persons. Later, it came to light that those passports were applied giving fake address and this petitioner along with other accused persons created forged passports to Srilankan Nationals under Asylum. Hence, the present complaint has been registered.
After hearing the learned counsel for the petitioner and the learned Additional Public Prosecutor, this Court is unable to understand that when one person applied for passport, after completing the Police verification by the jurisdictional Police officers, the Passport Authority can issue the passport and without the help of the Police officers, no person can get the fake passports. In view of the above, the Deputy Superintendent of Police, Pattukkottai, Thanjavur District, is directed to appear before this Court on 06.02.2024, to explain as to why the Police officers, who verified the details of the persons, who obtained fake passports, are not arrayed as accused in this case.
