Applicant is in judicial custody in Sessions Trial No.511 of 2024, State Vs. Rajkumar @ Malli and Another, pending in the court of FTC/Additional Sessions Judge/Special Judge (POCSO), Rudrapur, District Udham Singh Nagar, which is based on Case Crime No.0234 of 2024, under Sections 363, 376 IPC and Section 3/4 of the Protection of Children from Sexual Offences Act, 2012, Police Station- Bazpur, District- Udham Singh Nagar. He has sought his release on bail.

Heard learned counsel for the parties and perused the record.

Learned counsel for the applicant would submit that the victim as well as the informant, who is the father of the victim, has been examined at trial. Both have not supported the prosecution and have been declared; there is no other evidence; statements have been referred to.

Learned State Counsel admits this fact.

Having considered, this Court is of the view that it is a case fit for bail and the applicant deserves to be enlarged on bail.

The bail application is allowed.

Let the applicant be released on bail, on his executing a personal bond and furnishing two reliable sureties, each in the like amount, to the satisfaction of the court concerned.
