Heard Learned Counsel for the Appellant.
This Appeal has been filed against the Order dated 12.10.2022 passed in CP(IB)248(MB)2018. By which Order, the Adjudicating Authority (NCLT, Mumbai Bench, Court-II) has fixed 21st October 2022 and directed the Official Liquidator or his authorised representative to be present on the next date of hearing and also to file Affidavit in reply. Learned Counsel appearing on behalf of Erstwhile Promoter Directors were also granted their liberty to file Affidavit in Reply in ten days.
Learned Counsel for the Appellant submits that matter is now fixed today i.e. 11.11.2022, we see no reason to entertain this Appeal since the Adjudicating Authority has only fixed the next date for appearance and for Replies to be filed.
Learned Counsel for the Appellant submits that no Reply has been filed so far by the Appellant. It is always open for the Appellant to make a request to the Adjudicating Authority in this regard.
With these observations, the Appeal is dismissed.
