Judgment
Sushrut Arvind Dharmadhikari, J
By way of instant writ petition, the petitioners are seeking police protection from respondent nos.4 to 6 and direction to respondent nos.2 and 3 not to harass the petitioners and other family members.
Learned counsel for the State pointed out that the petitioners have already availed the remedy by filing an application under section 156(3) of the Code of Criminal Procedure on 12.11.2022 as well as a complaint under section 200 of Code of Criminal Procedure has also been filed on 12.11.2022, which are pending, and without even giving respondents breathing time to follow the procedure and pass necessary orders, the petitioners have rushed this Court. In such circumstances, no directions can be issued.
Taking into consideration the totality of the facts and circumstances of the case, the concerned Magistrate is directed to decide the application filed by the petitioners under section 156(3) of CrPC, as expeditiously as possible in accordance with law.
It is made clear that this Court has not expressed any opinion on the merits of the case.
With the aforesaid, the petition stands disposed of.
