The present Second Appeal is arising out of the judgment dated 19/9/2018 passed in Regular Civil Appeal No. 44-A/2017 by which a decree of eviction has been granted keeping in view Sec. 12(1)(c) of the M. P. Accommodation Control Act, 1961.

Facts of the case reveal that the respondent before this Court / plaintiff Agrawal Panchaan Samaj has filed a Civil Suit against the appellant / defendant stating categorically that a shop at the ground floor of the Dharamshala is in possession of the defendant. It was also pleaded that an agreement took place between the father of the defendant and the plaintiff on 1/3/1962 and in the agreement it was categorically mentioned that as and when the Dharamshala shall be in need of the premises, the defendant / tenant shall be handing over the vacant possession. It was further stated in the plaint that after the death of the defendant's father, the defendant inspite of repeated requests did not vacate the suit premises and also did not pay rent for the period 01/04/2012 to 01/10/2013. It was also stated that the defendant was in a habit of creating nuisance and abusing the Office Bearers of the Dharamshala. Another ground was raised that the Dharamshala is in need of the premises as on account of passage of time the Dharamshala needs a larger premises as marriages are taking place in the Dharamshala and Idol of God has to be installed. It was also stated that on 21/10/2013 a notice was issued to the defendant to vacate the premises and to pay the arrears of rent and in those circumstances, the suit was filed claiming possession, arrears of rent and mesne profits. The trial Court has dismissed the suit and the appellate has reversed the finding and has passed a decree of eviction.

Learned counsel for the appellant has argued before this Court that the appellant is not the tenant. On the contrary, he is the owner of the premises, the landlord tenant relationship does not exist and, therefore, the judgment delivered by the appellate Court deserves to be set aside.

This Court has carefully gone through the evidence adduced by the parties and the pleadings made in the matter. Though it has been argued before this Court that the appellant is not a tenant in respect of the premises in question by the learned counsel, but the pleadings in the Written Statement which was filed before the trial Court in paragraph 1 makes it very clear that the appellant who is defendant has categorically stated that the rent of the shop is on annual basis and not on monthly basis. In paragraph 3(a), (b) and (c) it has been categorically stated on Oath that rent was being paid regularly to the plaintiff and there are no arrears of rent.

This Court really fails to understand that in case the appellant is not a tenant, why he was paying rent to the plaintiff and this Court is not able to digest the fact that a person who is owner of a premises will be paying rent to a stranger.

The appellate Court has meticulously examined the evidence and paragraph 11 to 14 of the judgment delivered by the appellate Court reads as under :

Based upon the evidence adduced by the parties, as there was also a disclaimer of title, Issue was also framed ie., Issue No. 3 which was in respect of Sec. 12(1)(c) of the M.P. Accommodation Control Act, 1961, this Court is of the considered opinion that the appellate court was justified in passing the decree of eviction.

Learned counsel for the appellant has placed reliance upon the judgment delivered in the case of Mahesh Kumar Kushwaha Vs. M/s. Piparia Enterprises and another reported in 2018 (III) MPJR 132; Ahmad Ali Vs. Zahida Begam and others reported in [2009 (4) MPLJ 682]; and, lastly upon the judgment delivered in the case of Sheela Vs. Firm Prahlad Rai Prem Prakash reported in (AIR 2002 SC 1264). This Court has carefully gone through the aforesaid judgments and in the light of the judgment delivered in the case of Sheela (supra), denial of landlord's title or disclaimer of tenancy by the tenant is an act which is likely to affect adversely and substantially interest of land, hence is a ground for eviction of tenant within the meaning of Clause (c) of sub-Section (1) of Sec. 12 of the M. P. Accommodation Control Act, 1961 and, therefore, this Court is of the considered opinion that as there was an Issue ie., Issue No.3 in respect of Sec. 12(1)(c) of the M. P. Accommodation Control Act, 1961, the appellate Court was justified in allowing the appeal.

This Court does not find any reason to interfere with the judgment passed by the appellate Court, as no substantial question of law is arising in the present Second Appeal.

Accordingly, admission is declined.
