Judgment
These Applications have been filed by the Authorised Representative Shri Anoop Prakash Awasthi. Learned Counsel appearing for the Authorised Representative prays for impleadment and reliefs as claimed in the prayer clause. By our order dated 21.07.2022, we have directed the Authorised Representative to give assistance to Hon’ble Justice (Retd.) Rajiv Sahai Endlaw for the purpose of convening meeting of the Committee of Creditors for selection of the new Resolution Professional.
Learned Counsel for the Appellant submits that Dr. R.K. Gupta who was earlier appointed by the NCLT by order dated 14.12.2021 has expressed his inability to assist Hon’ble Justice (Retd.) Rajiv Sahai Endlaw. It is submitted that Hon’ble Justice (Retd.) Rajiv Sahai Endlaw has taken assistance from Mr. Zameem Ahmed Khan, Director (Computers), Delhi High Court.
Let Mr. Zameem Ahmed Khan assist Hon’ble Justice (Retd.) Rajiv Sahai Endlaw. We do not see any reason to give any financial power to Authorised Representative. The Authorised Representative shall only provide necessary records to Hon’ble Justice (Retd.) Rajiv Sahai Endlaw for convening the meeting. The handing over the entire assets etc. shall await selection of the new Resolution Professional.
Applications I.A. No. 2537 & 2539 of 2022 are disposed of accordingly.
