The petitioner is aggrieved due to the pendency of the Case No.23 of 2022-2023, “Sri Rajiv Kumar and Others vs. Project Director, National Highway Authority of India and Another”. Therefore, the petitioner has filed the present writ petition with the following prayers: -

“(A) A writ, order or direction in the nature of mandamus directing the learned District Magistrate/ Sole Arbitrator, Dehradun to decide the Case No.23 of 2022-23, (Sri Rajiv Kumar and Others vs. Project Director, National Highway Authority of India and Another) as early as possible (Annexure No.4)”.

(B) Any other writ, order or direction as this Hon’ble Court may deem fit and proper under the facts and circumstances of the case.

(C) To award cost throughout to the petitioner.”

Heard Mr. Bhupesh Kandpal, learned counsel for the petitioner and Mr. Suyash Pant, learned Standing Counsel for the respondent nos.1 and 3.

The said case is pending since, 2022.

The District Magistrate/ Sole Arbitrator, Dehradun is directed to decide the said case (No.23 of 2022-2023) as per law as expeditiously as possible and without granting any unnecessary adjournment to either of the parties.

Accordingly, the present writ petition (WPMS No.2854 of 2024) is disposed of in the aforesaid terms.

It is made clear that this Court has not expressed any opinion on the merit of the case.
