1.

THIS complaint has been filed by the complainant for reconnection of the telephone No. 7526449. It is alleged by him that the telephone connection has dis-connected because the respondent wanted him to deposit an amount of Rs. 3,20,045/- in respect of telephone connection No. 776379 which belongs to another person.

2.THE complaint has been contested by the respondent. THEy have inter-alia pleaded that the telephone connection was not dis-connected because of not having disposited the amount of Rs. 3,20,045/- in respect of telephone No. 776379 but for not depositing the telephone bills of the disputed telephone dated 5.3.93, 25.3.93 and 10.4.93 for Rs. 10,054/-, Rs. 7,851/- and Rs. 2,962/- respectively. It is not disputed by the complainant that the said bills have not been deposited by him. He, however, says that the respondent was not ready to accept the aforesaid amount when the complainant went to deposit the amount. This assertion of the complainant is not believable. THE amounts of the telephone bills are being taken by the Banks as well. Mr. Pattjoshi stated that no such instructions were issued to the Banks or to the counters of the respondent where the bills were accepted that the aforesaid amounts be not accepted from the complainant.

THE complainant states that the said amounts will be deposited in accordance with the agreement. In case the respondent does not restore the telephone after the aforesaid amounts have been deposited, the complainant may file a fresh complaint in that regard. THE other objections raised by the respondent in the written statement are left open.

5. IN view of the aforesaid reasons the complaint is dismissed. No order as to costs. Complaint dismissed.
