Judgment
Kurian Joseph, C.J. 1. The writ petition has been filed with the following prayers:
a) That the Respondent-department may kindly be directed to take over the Sarswati Sr. Section
School Randhara immediately alongwith staff in view of Annexure P-1 whereby it is evidently clear that institution of the Petitioner fulfill all the codal formalities for taking over by the Govt.
b) That the action vide which the services of the Petitioners has been terminated by the Respondents may kindly be declared as null and void in view of Annexure P-25.
In reply at para 10, it is stated as follows:
That in reply to this para it is submitted that as per information received from Principal concerned the meeting was held at GSSS 2 Randhara on 07.04-2007 and it was decided that the staff of privately managed schools will be given preference for appointment as per PTA policy. But the Pradhan of the PTA made appointments at his own level without completing the codal formalities like interview etc. by the duly constituted selection committee.Therefore, the Petitioners can not be selected/appointed as per procedure and after completing the codal formalities as required under the procedure.
In case the Petitioners have any dispute with regard to the factual position, as stated in the reply, it will be open to them to approach the second Respondent, in which case the matter will be duly considered by the second Respondent and appropriate action in accordance with law in the matter will be taken within another four months.
The writ petition is disposed of, so also the pending applications, if any.
