Learned counsel for petitioner submits that present petition is squarely covered by judgment dated 17.7.2020 passed by a Coordinate Bench of this Court in CWPOA No. 98 of 2019, titled Ashok Kumar Rana vs. State of H.P. and others. Record of CWPOA No. 98 of 2019 has been requisitioned, on perusal whereof, it establishes that both petitions are similar in nature except the date of impugned orders, whereby cases of petitioners were rejected by the Director of Higher Education.

2 Reply(ies) to both petitions i.e. in present petition and in CWPOA No. 98 of 2019 are identical in nature.

3 In view of above, I find that present petition is squarely covered by judgment passed by the Coordinate Bench in CWPOA No. 98 of 2019 titled Ashok Kumar Rana vs. State of HP and the said judgment shall be applicable in present case also for all intends and purposes.

4 Consequently, this petition is disposed of with directions that judgment in case titled Hridya Prakash vs. State of HP reported in (2012) Sup.Him LR 2279; (2011)3 Sim.LC 144 and judgment dated 7.5.2019 passed by Erstwhile H.P. State Administrative Tribunal in case OA No. 1134 of 2015, titled Kuldeep Singh vs. State of HP and others, shall be applicable as mutatis mutandis in present petition also for all intends and purposes. Accordingly, respondents are also directed to extend all consequential benefits to petitioner on or before 15th December, 2020.

Pending miscellaneous application(s), if any, also stands disposed of.
