Judgment
S. Siri Jagan, J.—The petitioners seek the following relief in this writ petition.
(i) Issue a writ of mandamus or any other writ order or direction directing the 2nd Respondent to consider Exhibit P3 and grant to the petitioners candidates promotion to the post of LDC/Village Assistant in the existing vacancies earmarked for Villagemen as per Rules with effect from the date of occurrence of such vacancies and grant to the petitioner all consequential monetary and other benefits.
The learned Government Pleader submits that in respect of identical relief, this Court has passed judgment dated 29.7.2010 in W.P.(c) No. 20518/10 and therefore, this writ petition also may be disposed of in terms of that judgment. The said judgment reads as follows:
The prayers in the writ petition are the following:
(i) Issue a writ of mandamus or any other writ order or direction directing the 1st and 2nd respondents to identify the number of vacancies of LDC/VA to be filled up by promotion from the post of Villagemen/Lastgrade Servants/Attenders as per Ext.P1 and P2 and fill up all those vacancies from among Villagemen/Lastgrade Servants/Attenders from the date on which the vacancy arose and the candidates qualified and grant to them all consequential benefits including assignment of seniority in the cadre of LDC/VA, forthwith:
(ii) Issue a writ of mandamus or any other writ order or direction directing the 1st and 2nd respondents to prepare integrated state wise seniority list of Villagemen/Lastgrade Servants/Attenders for promotion to the post of LDC/VA, forthwith.
By judgment dated 26/7/2010 in WP(C) No. 20473/10, this Court has already disposed of a similar writ petition accepting the contention of the respondents that before the preparation of the state wise integrated seniority list, Special Rules will have to be finalised. Therefore the second prayer in the writ petition will have to await the finalisation of the Special Rule and the first prayer in the writ petition can only be considered thereafter.
Writ petition is disposed of as above
In the above circumstances, this writ petition is also disposed of in terms of that judgment.
