Learned counsel for the rival parties are heard.

This is first bail application u/S.439 Cr.P.C filed by the applicant for grant of bail.

The applicant has been arrested 26.04.2022 by Police Station Nagra, District Morena in connection with Crime No.63/2022 registered in relation to the offence punishable u/Ss. 420, 272, 273 of IPC.

Learned counsel for the applicant submits that the allegation regarding the offence under Sections 272, 273 and 420 IPC is only against the co-accused Dinesh Baghel and there is no allegation even in the FIR against the present applicant Rajesh Singh and he has been implicated only on the ground that he is brother of co-accused Dinesh Baghel who was found carrying the alleged material in the vehicle. He submits that the present applicant is in custody since 26.04.2022. Accordingly, he submits that the applicant deserves to be enlarged on bail.

Per contra, learned counsel appearing for the State has opposed the bail application and prays for its rejection.

Considering the over all facts and circumstances of the case, without commenting upon the merits of the case, this Court deems it appropriate to allow this application. Accordingly, the bail application is allowed. The applicant is directed to be released on bail and on furnishing surety bond of Rs.50,000/- (Rs. Fifty thousand Only) with one solvent surety in the like amount to the satisfaction of trial Court.

This order will remain operative subject to compliance of the following conditions by the applicant :-

The applicant will comply with all the terms and conditions of the bond executed by him;

The applicant will cooperate in the investigation/trial, as the case may be;

The applicant will not indulge himself in extending inducement, threat or promise to any person acquainted with the facts of the case so as to dissuade him/her from disclosing such facts to the Court or to the Police Officer, as the case may be;

The applicant shall not commit an offence similar to the offence of which he is accused.

The applicant will not seek unnecessary adjournments during the trial;

The applicant will not leave India without previous permission of the trial Court/Investigating Officer, as the case may be.

Application stands allowed and stands disposed of.

Let a copy of this order be sent to the trial Court concerned for compliance.
