Judgment
Tarlok Singh Chauhan, J
On 10.09.2019, this Court passed the following order:-
“Notice. Mr. Adarsh Sharma, learned Additional Advocate General and Mr. Rajesh Kumar learned ASGI, appear and accept service of notice on behalf of respondents No. 1 and 2 & 3. Reply be filed within two weeks. List on 26.09.2019.
In the interim, the selection/ appointment against the post(s) of Pharmacist by respondent No.1, if any, shall be subject to final outcome of the writ petition.”
However, on 19.12.2019, the petitioner was allowed to appear in the counseling held on 30.12.2019, as is evident from the order, which reads as under:
“Learned Senior Additional Advocate General on instructions submits that the result of the counseling conducted for filling-up the post of Pharmacist on batch-wise basis from amongst the category of wards of ex-servicemen has not yet been declared. The complaint is that the petitioner has not received the intimation sent to him through post for appearance in the counseling on the date and time fixed for the purpose. Without prejudice to the rights and contentions of the parties in this writ petition, we direct respondent No.1 to allow the petitioner to appear for counseling on 30.12.2019 at 11.00 a.m. before the Selection Committee in his office. His result, however, shall not be declared without leave of the Court. List on 10.01.2020.
The result of the candidates for the post of Pharmacist, on contract basis, for a period of three years (Batch-wise Ward of Ex-servicemen) has been produced in a sealed cover, which has been opened in the Court and the petitioner has been found to be eligible.
Since the petitioner is found to be eligible, we have no doubt in our mind that he would be appointed as per his eligibility and turn. The petition stands disposed of accordingly, so also the pending miscellaneous application(s), if any.
Record/result is ordered to the office of learned Advocate General.
