Judgment
Avneesh Jhingan, J
The matter has been taken up for hearing through video conferencing due to COVID-19 situation.
This is a petition seeking anticipatory bail in FIR No. 50 dated 22.2.2020 under Sections 420, 120-B IPC registered at Police Station Sadar Dhuri
District Sangrur.
On 18.8.2020, the following order was passed.
''Notice of motion.
On the asking of the Court, Mr. S.S. Deol, Deputy Advocate General, Punjab, to accept notice on behalf of the respondent-State. Let a copy of the
paper-book be supplied to him.
List on 01.12.2020.
Meanwhile, in the event of arrest of the petitioner by the Arresting/Investigating Officer, he shall be released on interim bail subject to the following
conditions:-
That he shall make himself available for interrogation by a Police Officer as and when required;
That he shall not directly or indirectly make any inducement, threat or promise to any person acquainted with the facts of the case so as to dissuade
him from disclosing such facts to the Court or to any Police Officer and;
That he shall not leave India without prior permission of the Court.''
Learned State counsel on instruction submits that the petitioner has joined investigation, however, consideration for Buffaloes purchased has not been
paid to the complainant.
Considering the facts in totality, more so that the FIR has predominant element of civil/commercial dispute, the interim bail granted is made absolute.
However, it is clarified that anything observed herein shall not be construed as an opinion on the merits of the case.
The petition stands disposed of.
