These two Bail Applications have been filed for grant of regular bail in connection with the Case Crime No. 1 of 2020, registered at Vigilance Sector, Dehradun, District Dehradun.

The applicant Rajesh Pal is in judicial custody since 26.09.2022 under Sections 420, 465, 467, 468, 471, 201, 120-B of the Indian Penal Code, 1860 and Section 13(1)(d) read with Section 13(2) of the Prevention of Corruption Act, 1988.

The applicant Vipin Vihari is in custody since 29.08.2022 under Sections 420, 465, 467, 468, 471, 120-B and Section 201 of the Indian Penal Code, 1860.

These two Bail Applications have arisen from one case crime number i.e. Case Crime No. 01 of 2020, therefore, these two Bail Applications are being considered and decided by this common order. Record of Bail Application No. 1405 of 2023 will be leading file.

Learned counsel for the applicants and learned counsel for the State submitted that the co-accused persons of the similar role, namely, Rajender Singh Pokhriya and Manohar Singh Kanyal have been granted bail by the Hon’ble Supreme Court.

The First Bail Application No. 1405 of 2023 and the First Bail Application No. 2373 of 2023 are allowed on the ground of parity.

Let the applicants, namely, Rajesh Pal and Vipin Vihari be released on bail on their executing personal bond and furnishing two reliable sureties, each in the like amount, to the satisfaction of the court concerned with the following conditions:-

i) Applicants shall attend the Trial court regularly and they shall not seek any unnecessary adjournment;

ii) Applicants shall not directly or indirectly make any inducement, threat or promise to any person acquainted with the facts of this case.

It is clarified that if the applicants misuse or violate any of the conditions, imposed upon them, the prosecution agency will be free to move the Court for cancellation of the bail.

A copy of this order be placed on the record of Bail Application No. 2373 of 2023.
