The petitioner, who has filed the present public interest litigation, has disclosed in para 1 of the writ petition that he is an Advocate by profession. The issue sought to be highlighted in the writ petition is alleged illegal encroachment of the land of various Mandi Parishads in the State.

We find from the material annexed along with the writ petition that the Managing Director of Uttarakhand Krishi Utpadan Mandi Board had himself sought information from the Secretaries of various Mandi Samitis regarding any encroachment in the Mandi areas. He is thus himself holding inquiry.

It is further evident from the communication dated 17.02.2026 (Annexure-2) that the Managing Director (Administration/Finance), Uttarakhand Krishi Utpadan Mandi Board had issued direction to the Secretary, Krishi Utpadan Mandi Samiti, Kichha for removing the encroachments made by the shopkeepers by erecting temporary structures on the covered courtyard. As such, we are not inclined to examine the issue in the present writ proceedings, particularly when the persons who are alleged to be in illegal occupation by raising temporary structures, are not party.

The present PIL is, accordingly, dismissed.
