Judgment
Mr. Digvijay Singh Jasol, learned Government Counsel
appears on behalf of the respondent No.4 also. Service is
therefore, complete.
Mr. Digvijay Singh Jasol, learned Government Counsel for
the respondents informs that Prayer - (A) sought by the petitioner
for extension of his period of service as substitute Teacher till
08.05.2017 has been granted by the respondents vide order dated
26.10.2016.
With regard to prayer for the salary of petitioenr for the
summer vacation, the same issue has been decided by Jaipur
Bench of this Court vide order dated 29.05.2014 passed in SBCWP
No.6031/2014 ( Dr. Bhanwar Lal Jat vs. State of Rajasthan 7 Ors.)
and the petitioner is entitled for this relief also.
In view of the above, the respondents are directed to pay
the requisite amount of Rs.1,97,480/- to the petitioner, within a
period of two months from today.
Mr. Nihar Jain, learned counsel for the petitioner makes an
additional prayer for the payment of interest for delay in making
the payment.
Looking to the overall facts and circumstances, the prayer for
interest is refused.
The writ petition is disposed of in above terms.
If the payment aforesaid is not made to the petitioner, within
a period of two months i.e. on or before 10.09.2017, the same
shall carry an interest @ 9% per annum from, the date, it became
due.
