The petitioner has filed the present writ petition under Article 226 of the Constitution of India, alleging that the petitioner had applied for the post of TGT (Arts) in pursuance of the copy of the advertisement dated 28.8.2008 Annexure-P1. The screening test and interview was also conducted and the results were also declared. The petitioner has filed the petition claiming the following relief:
(i) That the Respondents 1 to 3 may be directed to appoint the petitioner on the basis of preference to be given to him, over the other candidates, as he being the only candidate who is the son of a freedom fighter in comparison to the others who are either the grandsons or grand daughters.
Learned counsel for the petitioner, during the course of arguments, submitted that in view of the changed circumstances, the respondents may be directed only to fill up the remaining two posts in accordance with rules. The prayer is accepted. The respondents shall fill up the remaining two posts of TGT (Arts) and steps for filling up the remaining posts lying vacant, if any, in accordance with the rules within a period of three months from the date of production of a copy of this order before the Principal Secretary (Education) to the Government of Himachal Pradesh by the petitioner or learned Assistant Advocate General. In view of the above, the writ petition stands disposed of. Pending application (s), if any, shall also stand disposed of.
