This Court vide order dated 01.09.2026 asked the petitioner to serve the copy of writ petition to any other counsel of Uttarakhand Transport Corporation other than Mr. N.S. Pundir, as Mr. Akshay Latwal, petitioner’s counsel was junior counsel of Mr. N.S. Pundir, learned counsel.
Today, Mr. N.S. Pundir, learned counsel for respondents, submits that Mr. Akshay Latwal, learned counsel is at present on the government side as A.G.A. and now he is independently working, therefore, there is no difficulty to argue in the present matter.
I found substance in the submission made by learned counsel for respondents. Heard learned counsel for the parties.
Learned counsel for petitioner submits that the controversy in this writ petition is squarely covered by the judgment passed by Coordinate Bench of this Court on 14.06.2022 in WPSS No.1593 of 2021 Balam Singh Aswal Vs. Managing Director and Others, and Batch of writ petitions, which were subsequently affirmed by the Division Bench of this Court in Special Appeal No.245 of 2022 Managing Director, Uttarakhand Transport Corporation v. Ashok Kr. Saxena, and batch of Special Appeals, decided on 04.04.2024.
Learned Counsel appearing for respondents-Corporation also does not dispute this fact.
In this view of the matter, writ petition is allowed in terms of judgment and order dated 14.06.2022 passed by Coordinate Bench of this court in WPSS No.1593 of 2021 Balam Singh Aswal Vs. Managing Director and Others, and Batch of writ petitions, which was affirmed by the Division Bench of this Court in Special Appeal No.245 of 2022 Managing Director, Uttarakhand Transport Corporation v. Ashok Kr. Saxena, and batch of Special Appeals, decided on 04.04.2024. The case of petitioner is abide by aforesaid judgment and order dated 14.06.2022, which was later on affirmed by the judgment and order dated 04.04.2024 in the Special Appeal as mentioned above.
