This matter is taken up through virtual mode.
Heard learned counsel for the Petitioner and learned Addl. Standing Counsel for the State.
The Petitioner is in custody since 23rd November, 2023 in connection with P.R. No.456/2023 of E.I and E.B Unit No.1, Cuttack, corresponding to 2(a)C.C. No.551/2023 pending in the court of learned J.M.F.C., Jajpur Road for the alleged commission of the offence under Section 52(a)(i) read with Section 55(B) of Odisha Excise Act.
It is alleged that the Petitioner had stored 600 liters of rectified spirit in 3 drums illegally.
Having regard to the submissions made by the learned counsel for the Petitioner and the materials on record particularly the fact that investigation into the case has progressed substantially and one of the co-accused person has already been released on bail, I find no reason to direct detention of the Petitioner in custody any longer.
Let the Petitioner be released on bail on such terms and conditions as may be imposed by the Court in seisin over the matter in the aforesaid case including the condition that he shall appear before the Court below on each date of posting of the case without fail.
The BLAPL is disposed of.
Urgent certified copy of this order be granted on proper application.
