Judgment
This matter is taken up through Virtual/Physical Mode.
The petitioner is seeking a mandamus for directing the Collector and District Magistrate, Mayurbhanj, Baripada for deciding the application filed by
the petitioner under Section 49 of the Odisha Excise Act, 2008 for surrendering the licences of four branch shops attached to Khunta Out Still liquor
main shop for the Excise year 2021-2022, in a time bound manner.
It is conceded position that the consideration money for the aforesaid four branch shops payable up to 31.03.2022 stands paid by the petitioner; and
the Collector through the learned Additional Government Advocate has prayed for four weeks time to decide the pending application for surrendering
the aforesaid Branch Shops. At this stage, learned counsel for the petitioner points out that his client has filed a revised application seeking surrender
of only three branch shops. So, the prayer is restricted for taking a decision regarding three shops within a stipulated time as prayed for in the revised
application.
In view of the above, we dispose of the writ petition with a direction to the competent authority to decide the aforesaid pending revised application
expeditiously but not later than 15th of March, 2022 and duly communicated to the petitioner within next two days.
