Rajesh Kumar vs State of H.P. and Others

Deepak Gupta, J.—This case is squarely covered by a judgment delivered by a learned single Judge of this Court in CWP (T) No. 6785 of 2008, titled as Narinder Singh Naik v. State of Himachal Pradesh and Ors. wherein on identical facts the Court held as follows:

The issue raised in this petition is no more res integral in view of the law laid down by their Lordships of the Hon''ble Supreme Court in The Direct Recruit Class-II Engineering Officers'' Association and others Vs. State of Maharashtra and others,

Accordingly, the petition is allowed. Respondents are directed to consider the case of the Petitioner for counting the period he has worked on contract basis with effect from 1995 till regularization with all the consequential benefits in view of the principles laid down in the judgment cited hereinabove. Needful be done within a period of ten weeks after the receipt of certified copy of this judgment by the Petitioner. No costs.

The present case is accordingly disposed of in the same terms and the Petitioner herein shall be entitled for the same benefits which are granted to Narender Singh Naik in CWP (T) No. 6785 of 2008. No costs.
