Judgment
This Appeal has been filed against order dated 19.09.2023 passed by the Adjudicating Authority by which order Section 9 application filed by the Respondent herein has been admitted. The Respondent has filed Section 9 application claiming an amount of Rs.13,58,249/- which was amount mentioned in the Part IV.
Today, when the Appeal is called for hearing, learned counsel for the Appellant has handed over a Bank Draft of Rs.13,58,249/- to learned counsel for the Respondent, which is duly accepted.
The entire amount having been paid, we are of the view that no purpose shall be served in keeping the appeal pending and continuing the CIRP any further. CIRP is closed.
In this Appeal we have already passed interim order on 27.09.2023, which it to the following effect:
“No further step shall be taken in pursuance of Impugned Order dated 19.09.2023.”
The Adjudicating Authority by the impugned order has directed to deposit Rs.2 Lakhs as IRP fee and expenses. Appellant shall also make payment of Rs.2 Lakhs to the IRP within period of two weeks from today by way of Bank Draft, which we find satisfactory to cover the cost and fee of the IRP. The IRP shall handover all records etc. of Corporate Debtor.
Appeal is disposed of accordingly.
