Rajesh Awasthi vs State of Rajasthan and Another

R.S. Chauhan, J.—According to the order dated 7.7.2010, both the parties, Mr. Rajesh Awasthi and Smt. Mamta Sharma, were present before this Court. Smt. Mamta Sharma stated that she no longer wishes to pursue the criminal case against Mr. Rajesh Awasthi for offences u/s 498A and 406 IPC. She further stated that she has also reached a compromise with Mr. Rajesh Awasthi. However, as the copy of the compromise was not available in the Court file, this Court directed the parties to submit a written compromise before this Court.

In pursuance to the order dated 7.7.2010, a written compromise has been submitted before this Court by the parties. The same shall be taken on record.

Considering the fact that both the parties have amicably settled their differences, considering the fact that both the parties have reached a compromise, this Court directs that the criminal proceeding pending before the Additional Chief Judicial Magistrate, Deeg in Criminal Case No. 76/2004 for offences under Sections 406 and 498A is quashed and set aside.

With these observations, this petition is, hereby, disposed of.
