Heard This is first bail application filed by the applicant u/s 439 of Cr.P.C. for grant of bail. The applicant is in custody in connection with Crime No.117/2012 registered against him u/s 393 of IPC and Section 11/ 13 of M.P.D.V.P.K. Act at Police Station Raun, District Bhind (M.P.).
The allegation against the applicant is that he tried to commit robbery. The complainant in the FIR stated that he was stopped with an intention to commit robbery and when another person came on the spot, the accused persons ran away. There is no recovery from the applicant.
Learned Panel Lawyer has informed to this Court that there is no previous criminal history of the applicant. She opposed the bail application and prays for its rejection.
Looking to the nature of allegation and fact that the applicant is in jail since 19/7/2012, but without commenting upon the merits of the case, the application is allowed and it is directed that the applicant be released on bail on his furnishing a personal bond of Rs.50,000/-(Rupees Fifty Thousand Only) with one solvent surety of the like amount to the satisfaction of trial Court for his regular appearance during trial. The applicant shall also comply with the conditions enumerated u/s 437 (3) of the Cr.P.C.
A copy of this order be sent to the concerning Court for compliance. Certified copy as per rules.
