Heard the learned counsel for the petitioner Sri G.K. Pandey and Sri Rakesh Pandey for respondents 2 and 3.
This petition in the nature of public interest litigation seeks a direction to the Oil Corporation for appointment of the LPG Distributor in pursuance of the advertisement dated 7.9.07.
Counsel for the Oil Corporation says that the appointment of the LPG distributor depends upon many factors, including the potentiality of the area and many more consideration and that no direction can be issued in public interest for opening of a retail outlet at a particular place.
The opening of LPG retail outlet or for that matter any other retail out is a matter of choice of the Oil Corporation. It is the own discretion of the Oil Corporation to see as to where the outlet should be opened.
The Court would rarely interfere in such matters, so as to ask them to open a particular outlet at a particular place.
Even otherwise, in a matter of commercial transactions, which are purely in business terms, the Court would not normally interfere.
In view of above, the petition in the nature of public interest litigation is not maintainable. It is a different matter that the person aggrieved may approach the Court, if they feel aggrieved.
The petition is wholly misconceived, which is hereby dismissed.
