Affidavit of service filed in Court is taken on record.

The instant writ petition has been filed for a direction upon the municipal authority to mutate the names of the petitioners, namely, Rajendra Nath Mullick, Samir Mullick and Biswajit Mullick as the shebaits and trustees of Sree Ishwar Sridhar Jeu and Sree Sree Lakshmi Mata Thakurani in the assessment books and records of the Kolkata Municipal Corporation in respect of the premises no.1, Sagore Dutt Lane, Kolkata – 700073.

Having heard the learned Advocates appearing for the respective parties and noting that a representation has been made by the petitioners, I am of the view that the municipal authorities may hear out the representation in accordance with law and in the process, as aforesaid if any application is filed by the petitioners the same shall also be considered and disposed of in accordance with law by passing a reasoned order.

It is expected that the decision shall be taken in this regard by the municipality as expeditious as possible preferably within 8 weeks from the date of this order.

It is made clear that this Court had not gone into the merits of the cause and it shall be open to the municipal authorities to take a decision without being influenced by any of the observations made hereinabove.

The writ petition, thus, stands disposed of.
