Learned counsel for the parties are present.
Learned counsel for the appellants submits that I.A. No. 645 of 2022 has been filed for suspension of sentence. He further submits that prayer for suspension of sentence was rejected twice earlier once on 29.11.2019 in I.A. No. 2147 of 2019 and thereafter on 01.10.2021 in I.A. No. 724 of 2021. Learned counsel submits that he has renewed his prayer for suspension of sentence on account of custody of the appellants. He submits that it has been stated in paragraph No. 8 of the I.A. that the appellants have remained in custody in connection with the present case for more than 3 years and maximum sentence awarded to the appellants is 6 years.
Learned counsel appearing on behalf of the State has no serious objection to the prayer for suspension of sentence considering the custody of the appellants. However, she submits that prayer for suspension of sentence was rejected earlier on merits.
After hearing the learned counsel for the parties and considering the custody of the appellants which has been stated to be more than 3 years and 4 months, the prayer for suspension of the sentence of the appellants is hereby allowed and the appellants are directed to be released on bail, during the pendency of this case, on furnishing bail bond of Rs. 25,000/-(Rupees Twenty Five Thousand) each with two sureties of the like amount, each to the satisfaction of learned Additional Sessions Judge-II, Latehar, in connection with Sessions Trial No. 55 of 2016, Subject to the following conditions:
(i) One of the bailors should be the close relative of the appellants.
(ii) The appellants would also furnish their self-attested copy of their Aadhar Card and phone numbers which they will not change during the pendency of the appeal.
(iii) The appellants will ensure their presence before this court as and when the appeal is taken up for hearing.
I.A. No. 645 of 2022 stands disposed of.
