Judgment

Rajbir and Gopi Ram have prayed for bail in a case registered vide FIR No. 44 dated 14.4.1988 under Section 306 read with Section 34 IPC at Police Station, Sahalawas, District Rohtak. Bimla wife of Rajbir accused is stated to have committed suicide by jumping in a well in village Judi. Rajbir and Bimla had visited this village in connection with the marriage of the son of Ram Singh brother of Rajbir. Both husband and wife were sleeping in a Kacha house. However, in the morning the dead body of Bimla was noticed in a well. The FIR was recorded by Om Parkash, Sarpanch of the village. The FIR mentions the earlier relations of Bimla and Rajbir were strained. However, with the intervention of Panchayat members, they started living together. One daughter was also born to Bimla who died and Rajbir was suspecting the birth of the daughter from somebody else. It is further mentioned that it was rumoured that Rajbir was harassing Bimla or that after killing her, she was thrown in the well.
Since the case has been registered U/S 306 IPC no notice can be taken of the fact that it was rumoured that she was killed and then thrown in the well. The circumstances as narrated above do not indicate that there was such harassment by Rajbir or Gopi Ram that Bimla committed suicide. Without further going into the merits Rajbir and Gopi Ram are directed to be released on bail on their furnishing bail bonds to the satisfaction of Chief Judicial Magistrate, Rohtak.
JUDGMENT accordingly.
