This petition under Article 226 of the Constitution of India read with Section 3(1)(C) of the Haryana Good Conduct Prisoners (Temporary Release) Act, 1988 has been filed for direction to the respondents to release the petitioner on parole for 6 weeks for agriculture purpose.

Learned counsel for the petitioner states that keeping in view the fact that the petitioner is the only bread earner, the composition of the family of the petitioner makes out i.e. 3 minor children and wife. It is also stated that there is no one to carry out the agriculture work.

The factum of agriculture land is duly acknowledged by learned State counsel. Earlier also, the petitioner availed parole for the purpose of admitting children to school, which he did not misuse.

In the circumstances, the petitioner is granted parole for three weeks' subject to furnishing surety bonds to the satisfaction of the concerned District Magistrate. The petitioner shall surrender before the jail authorities on the date and time to be noticed by the releasing Court/District Magistrate.

The writ petition is allowed accordingly.
