The applicant has preferred this first bail application under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023 for grant of regular bail as he has been arrested in connection with Crime No. 236/2026 registered at Police Station Jamul, District Durg (C.G.) for the offence punishable under Sections 21(B) and 27(A) of the Narcotic Drugs and Psychotropic Substances Act, 1985 (hereinafter, “NDPS Act”).

On the said basis, the aforesaid offence was registered against the accused persons and they were arrested.

3.

Mr. Vikas Kumar Pandey, learned counsel appearing for the applicant, would submit that the applicant is innocent and has falsely been implicated in the present case. He would further submit that the quantity of contraband seized from the possession of the present applicant i.e. 81.4 grams of Heroin is less than commercial quantity. He would also submit that co-accused Rajvinder Kaur has already been granted bail by this Court vide order dated 06/08/2026 passed in MCRC/5593/2026. He would also submit that the applicant has no previous criminal antecedents, the charge-sheet has already been filed and the applicant has been in judicial custody since 10/04/2026, and since the conclusion of the trial is likely to take considerable time, the applicant may be enlarged on regular bail.

4.
