Judgment
Arun Kumar Mishra, C.J.—There is delay of 40 days in filing the appeal. For the reasons stated in the application, delay in filing appeal is condoned. Application under Sec. 5 or the Limitation Act stands disposed off.
Certain informations were sought under the Right to Information Act, 2005 (hereinafter referred to as ''the RTI Act''). The Rajasthan Information Commission, vide order dt. 13.06.2008, directed Information No. 1 to 5 to be furnished by the appellants. Chief Information Commissioner, with respect to Information No. 1, for how many posts of Lecturer in Geography interviews were held, directed that same be disclosed.
With respect to Information No. 2 relating to how many general women candidates, who were called for interview, their names and educational qualification, the Chief Information Commissioner directed that roll number and their educational qualification except names can be disclosed.
Information No. 3 was with respect to names, addresses and educational qualification of successful women candidates of ''General'' category.
Information No. 4, which was sought, was with respect to how many general women candidates were holder of Gold Medals and qualification of Ph.D., SLATE and B.Ed., the Chief Information Commissioner ordered that in case, such information is available in the consolidated form, may be furnished, but in case each form was required to be looked into for collection of information sought, then that will fall within Section 7(9) of the RTI Act and may not be furnished by the appellants.
With respect to Information No. 5 as to how much marks were obtained by the successful women candidates and marks given by the interview board, it was ordered that the same may also be disclosed.
Order of Chief Information Commissioner has been affirmed by the Single Bench observing at the same time that as regards individual details of such female candidates in general category holding Gold medals and qualification of Ph.D., B.Ed., & SLATE, the Chief Information Commissioner has made it clear that if such information being not consolidated and maintained but has to be made available from the forms of individual applicants, that can certainly be denied in view of Section 7(9) of the RTI Act.
In the circumstances, after hearing learned counsel for the parties, we clarify with respect to Information Nos. 2, 3 and 4, part of information which is not maintained and consolidated, has to be collected from the forms of individual applicants except that, remaining part of information be furnished. Out of information prayed for whatever is available in consolidated form, has to be furnished. With the aforesaid modification in the impugned order, the appeal is disposed off.
