Rajan Ram vs State of Uttarakhand

Applicant- Rajan Ram, who is in jail in 2 connection with Crime No. 142 of 2010 relating to offences punishable u/s 409, 420, 406, 218, 467, 468, 471 I.P.C., and one punishable u/s 3/7 Essential Commodities Act, 1955, police station Kapkot, District Bageshwar, has sought his release on bail.

Applicant is Store Incharge in the office of District Supply Officer Bageshwar. The allegation is that on the inspection by local Member of Legislative Assembly mis management was found in distribution of Mid day meal ration of the school children. Co accused Mahendra Singh Burathokey has already been granted bail by this Court.

Having considered submissions of learned Counsel for the parties, and after going through the papers on record, without expressing any opinion as to final merits of the case, this Court is of the view, that applicant deserves bail.

The Bail Application is allowed. Let the applicant-Rajan Ram be released on bail on executing personal bond and furnishing two sureties, each of the like amount, to the satisfaction of Chief Judicial Magistrate, Bageshwar.
