Judgment
P. Ubaid, J.—This is a revision brought against an order passed by the Additional Chief Judicial Magistrate (Economic Offence), Ernakulam u/s 451 of Cr.P.C. The revision petitioner herein filed C.M.P. No. 1058 of 2014 claiming that he is the registered owner of the vehicle involved in Crime No. 473 of 2014 of Ernakulam Town South Police Station the application was resisted by the 2nd respondent herein. Finding that the 2nd respondent is the person, who had actual custody and control over the vehicle, the learned Magistrate dismissed the claim made by the revision petitioner. He is aggrieved by the said order dated 29.4.2014.
This revision is, in fact, not maintainable because it is against an interlocutory order or interim arrangement made by the Court u/s 451 Cr.P.C. It is an order having limited force and effect, limited tenure, and the said order is subject to final order to be passed u/s 452 Cr.P.C. Revision against such interim order cannot be brought under Sections 397 and 401 of Cr.P.C.
In the result, this revision petition is dismissed.
