Dinesh Maheshwari, J.—The learned counsel for the petitioner submits that the subject matter of this petition is, on essential particulars, similar to that of the other petitions, which were considered together by this Court on 03.05.2013 and interim orders were passed permitting the writ petitioners to file hard copy of the application by this date, i.e., 06.05.2013. It is submitted that the present petition was also filed on 03.05.2013 and as per Court permission, was to be listed on that day itself but could not be listed for delay in the office; and for this particular petition, standing on all essential particulars, including date of filing, at par with the other petitions wherein orders were passed on 3rd inst., the petitioner herein deserves to be granted the same indulgence.

On 03.05.2013, with reference to the order passed by a Division Bench of this Court at Jaipur Bench on 01.05.2013, we passed an interim order permitting filing of the hard copy of the application by the concerned petitioners and further granted indulgence that such applications could be filed by this date, i.e., 06.05.2013 for the peculiar reason that the last date otherwise fixed for receiving on-lines application was 04.05.2013 and that being Saturday, the regular office working of the respondents was not to take place before this date, i.e., 06.05.2013.

Having regard to the circumstances, where the present case stands essentially at par with the cases considered on 03.05.2013, it appears appropriate to pass similar nature order in the present petition too.

Hence, it is ordered that the petitioner herein is permitted to submit hard copy of his application before the concerned departmental authority. So far the date of submission of such hard copy of the applications is concerned, in the interest of justice, it is considered appropriate to observe that under this order, the petitioner would be permitted to submit the hard copy of the application before the concerned departmental authority latest by today, i.e., 06.05.2013.

It is, of course, made clear that the permission under this order shall be of an interim arrangement only; shall not confer any other right on the petitioner; and would abide by the final decision to be rendered in these proceedings. The entire selection process shall, however, remain subject to the final adjudication in these proceedings.
