Judgment
Hemant Gupta, J.—The petitioner invoked the writ jurisdiction of this Court claiming benefit of quota for appointment to the post of Lecturer in Mathematics as dependent of an Ex-serviceman. The writ petition filed by the petitioner was allowed on 12.11.1990 and the respondents were directed to consider the claim of the petitioner against one post of Lecturer to be reserved for Ex-Servicemen.
Learned Counsel for the petitioner admits that in the subsequent selection process, the petitioner was appointed as Lecturer in Mathematics on 18.2.1991.
I find that the present contempt petition is not only barred by limitation, but in fact, is also not otherwise maintainable. The petitioner was appointed as Lecturer in Mathematics in the year 1991 i.e. soon after the orders were passed by this Court. The petitioner has not made any grievance during the last 19 years.
The direction of this Court on 12.11.1990 was to consider the candidature of the petitioner against one post of Lecturer kept reserved for Ex-Servicemen within a period of two months. Since the petitioner has been appointed as Lecturer in Mathematics, the order passed by this Court stands complied with.
The assertion of the petitioner is that in terms of the direction of this Court, the petitioner may be entitled to seniority and additional increment. The said assertion is wholly misconceived. The petitioner is not entitled to any benefit of seniority or increment prior to his appointment.
I find that the present contempt petition is nothing, but a patent abuse of process of Court. Therefore, the same is dismissed with costs of Rs. 10,000/-. Such costs be deposited with the Haryana State Legal Services Authority, Chandigarh, within a period of one month.
